TERMS AND CONDITION WARRANTY:

OUR COMMITMENT TO, OUR VALUED CUSTOMERS:
TorqueWorks Racing warrants products will be free from defects in materials and manufacturing workmanship for one year from the date or the purchase. Products are not warranted against normal wear and tear, product modification, neglect, incorrect storage, damage caused by accidents, abuse, misuse, negligence, any claims based on misrepresentations by the seller; or through use other than that which is described in our literature or published under the Warranties section on our website. If the product is found to be defective then, customer's sole remedy and the manufacturer’s only obligation will be to repair or replace the product in TorqueWorks Racing’s sole discretion. TorqueWorks Racing reserves the right to replace a discontinued product with a comparable product. Any replacement units or parts may be new or rebuilt. This warranty provides the customer with specific legal rights according to United States law and other rights, which vary from state to state.

Except for those warranties provided with a product, the products purchased by customer are sold “as is,” and TorqueWorks Racing disclaims, to the fullest extent possible under applicable law, any and all representations and warranties, express or implied, with respect to the products purchased by customer, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

LIMITATION of LIABILITY:

In no event shall TorqueWorks Racing, its subsidiaries or affiliates, or their respective partners, officers, directors, employees, shareholders, representatives or agents be liable for direct, special, incidental, consequential, punitive, or indirect damages (including but not limited to, attorneys' fee and costs, loss of data, use or profits), however caused, whether for breach of contract, negligence, or otherwise, and whether or not TorqueWorks Racing has been advised of the possibility of any such damages and, as is the reasonable convention for such consumer products, TorqueWorks Racing shall be held harmless from any liability stemming from consequences, whether direct, or indirect or accidental, or for any other type of damage arising or resultant from the use of TorqueWorks Racing products. TorqueWorks Racing's maximum liability arising from any product sold by TorqueWorks Racing shall not exceed the suggested retail price of such product.
